1. As per article IX of the MAKAKALIKASAN (Nature Party Philippines) Constitution and By-Laws (CBL), the following pertinent provisions related to the National Council and their elections is hereby noted as GENERAL GUIDE for this election:
Section 1. In between National Assembly, the highest governing body of the Green Party is the National Council. It is also the lead implementing body of all National Assembly decisions
Section 2. The National Council shall be composed of the following
2.1. National Chairperson
2.2. Vice Chairperson
2.3. National President
2.4. National Secretary-General
2.5. National Treasurer
2.6. National Spokesperson
2.7. National Auditor
2.8. Regional Division Convenors
Section 3. The roles and responsibilities of the members the National Council shall be as follows:
3.1. The Chairperson shall be the presiding officer of the National Assembly. He/She shall be the National Leader of the Party and shall represent it in any national and international bodies and gatherings that require our participation.
3.2. The Vice Chairperson shall succeed as Chairperson for the unexpired portion of the term in case of vacancy therein. She/he shall also preside in meetings in case the Chairperson is absent
3.3. The President shall be the Chief Executive Officer of the Party. He/she shall lead and convene the National Council and its meetings and processes. He/she shall also convene the National Executive Committee
3.4. The Secretary-General shall be the Chief Operating Officer of the Party and shall take charge of the operations of the National Secretariat. He/She shall also take the minutes of the all the meetings of the National Assembly and the National Council and shall be the custodian of all its records
3.5. The Treasurer shall be the custodian of the funds and other properties of the Party and co-signatory of the President or the Secretary General for the disbursement of funds
3.6. The National Spokesperson shall be the public voice of the Party on all matters regarding our campaigns and activities. He/She will take charge of our relationship with media.
3.7. The National Audit shall conduct an annual internal audit of the financial and management system of the Party and submit his/her report to the National Council.
3.8. The Convenors of the Regional Districts shall represent the interest of their respective Regions
Section 4. The National Chairperson, National Vice Chairperson, National President, National Secretary-General, National Treasurer, National Spokesperson and National Auditor shall be elected during the National Assembly. The Convenors of the Regional Districts are elected by their respective district members.
Section 5. The National Council shall serve for a term of three (3) year
Section 6. No member shall hold more than one (1) elective party position
2. Any member (full member, associate, honorary) may nominate candidates for the 7 positions of the national council officers from among the FULL & HONORARY MEMBERS (including those with conditional full membership) of the Party within the period designated for nomination. Nominating persons may refer to the Party Members Roster in our website for an updated list: www.naturepartyph.weebly.com/members
3. Elections will be conducted through close-ballot system and where possible, use online ballots for convenience. Voters will cast their votes on all 7 positions in one ballot.
4. Where there is only one candidate for a position, the sole candidate shall be declared a winner with just one vote cast in his/her favor.
5. Where no nomination or candidacy was received, this/these positions shall be declared vacant and the National Assembly may opt to empower the National Council with the assistance of the Election Committee or Election Officer to schedule a special elections to fill up this/these positions; preferably during the National Assembly or online within the next one month. Another option for the National Assembly is to designate the newly elected National Council to convene; preferably in a special session of the national council before the end of the ongoing National Assembly, to APPOINT from any full member who may be persuaded to the accept the appointment to fill in the vacant positions temporarily for no more than one (1) year and before the end of which, an online special national council assembly shall be held to replace with elected officials the appointed officer/s through an elections.
6. Only official delegates in a National Assembly are qualified voters in the elections. Section 4, 5 and 6 of Article VII (National Party Organization) may apply relating to designation of voting delegates. However, during the Founding National Assembly, Section 4 which reads "While all full members may attend and participate in the National Assembly, only the official delegates from each of the Chapters and members of the National Council will have voting rights. Every Chapter can designate one (1) delegate to the National Assembly who shall have one (1) vote. Each of the elected National Council members will also enjoy one (1) vote." shall be suspended allowing for all designated FOUNDING MEMBERS to be official voting delegates in the election of the national council
7. The Election Officer or Election Committee shall declare the candidates for every position after reviewing all nominations submitted. Details of these shall be made available to the voting delegates using a page in our website: www.naturepartyph.weebly.com/natcouncil.election.candidates
8. Absentee candidates may be allowed provided he/she is an eligible candidate and that he/she is informed of such candidacy before votes are cast. Acceptance of nomination shall not be necessary to proceed with the declaration of candidates and the casting of votes. However, if a candidate wins the election and he/she does not accept it, the position shall be awarded to the candidate with the next highest vote. Where said absentee candidate is the only candidate and his/her non acceptance will mean no candidate was elected, the position shall be declare vacant subject to section 5 of this guidelines.
9. While nomination in multiple positions will be allowed, as section 6 of Article IX of our CBL states that "No member shall hold more than one (1) elective party position " where a candidate with multiple nominations/candidacy wins in more than 1 position; the higher position in the order of the following will be awarded to him/her: National Chairperson, National Vice Chairperson, National President, National Secretary-General, National Treasurer, National Auditor and lastly National Spokesperson. In position/s where such a multiple winning candidate must give up this/these positions in favor of the higher position he/she won, the next candidate/s with the next highest votes shall be declare winner/s of this/these positions. Where no other candidate may be declared then the next step shall be subject to section 5 of this guideline.
10. A tie in the votes for any position would be resolved with a toss coin to be initiated by the election officer or committee witness by the national assembly before announcement of winning candidates are made.
11. The Election Committee shall be composed of 2 to 3 members in good standing who is shown not to have any vested interests or conflict of interests in said elections and in relation to the candidates for said election. In cases where a committee cannot be formed to perform this function, an Election Officer shall be designated. The Secretary-General shall designated the Election Officer or the Election Committee and properly orient them on these guidelines and turn over to them all access to pertinent information, tools, etc. to allow them to perform their role independently. Within the bounds of the provisions of this guidelines, the Election Committee or the Election Officer's decision shall be followed. The decisions of the committee or the election officer may only be appealed to the incumbent/outgoing National Council whose decision shall be final; subject to rules pertinent to the hierarchy of decision making between the National Council and the National Assembly.
